Legislative amendment Catalunya: squatters? Neighbours can take action!
In Spain houses do get squatted sometimes. This is very annoying for the owner of the property, but also for the neighbours (especially in cities where people live in apartment buildings). In Catalunya a law has been enacted which gives neighbours of squatters an option to take action.
A squat sometimes occurs in Spain when homeowners do not use the property and also do not rent it out. When they do not respond to this illegal occupation immediately, it can take quite a long time before the squatter can be evicted.
To prevent this situation from causing inconveniences to the rest of the owners and users of the apartment building, a legislative amendment was made in Catalunya on February 18, 2023.
This amendment gives the right to other apartment owners to request the municipality – in case of disruption of the co-living situation, disturbance of public order, or when public safety is in danger – to demand from the home owner to prove within one month, that legal steps in order to evict the squatters have been taken.
After this period expires, the municipality can request an expulsion of the squatters at court. The owner may then face fines for not having taken action himself.
