Unfortunately, I have to dismiss employees in my Spanish company, what should I do?
Spanish labour law is very different from Dutch labour law. The way of dismissal, dismissal procedures and compensation for dismissal are quite different than in the Netherlands. In Spain, for example, before going to court, the parties have to go through a mediation process. Furthermore, in Spain there is no prior valuation of the dismissal (the dismissal does not have to be approved beforehand by a judge or an authority). There is only an ex-post evaluation.
It is therefore important that you are always well advised and assisted by Dutch-speaking lawyers specialised in Spanish labour law.
