We regularly receive questions about renting (or leasing) in Spain and related rights.
This may be regarding renting a home or a business premises. We also often deal with renting and subletting living space. The rental legislation in Spain is, of course, different from that in the Netherlands. Although the legislation has changed considerably in recent years, there are still several “old” elements that need to be taken into account.
To rent a house in Spain as a foreigner, you need a NIE (Foreigner Identity Number). It is also necessary for Erasmus students who temporarily stay in Spain. We will be happy to assist you in applying for a NIE.
For non-permanent rentals there are other rules, so it is necessary to investigate whether non-permanent rentals require a special license.
When renting a house for a period of less than a month, many times a tourist license is required. It should be noted that a large number of cities, including Barcelona, currently no longer issue these permits. The fines for not complying with these rules range from € 10.000 to € 70.000.
